If he's never paid any support, you may be able to agree to terminate rights, get all the requisite documentation signed and notarized (I know it takes a minimum of 3 months in PA even when all parties agree (and longer when they don't, personal experience), but I don't know the law in NC), then refuse to grandfather the x years of no-support payments he's failed to make. But it might be more trouble than it's worth.
I'm in agreement with seemingly everyone else here, in that you will know better about how this will shake out after you talk with a good lawyer.
