It's definitely B&W. if you load it up in photoshop and look at the RGB values, you'll see R=G=B for any point you care to sample. That's the definition of true grayscale in an RGB colorspace.

I don't think it's too flat, but that's a matter of personal opinion. I'd suggest you open up your 3/4 tones a bit while keeping your mid and quarter tones about the same to pull some detail out of the shadows if the original can handle the move without posterizing. Or you could add contrast and turn it into more of a silhouette, if that's what you're going for.

If I'm posting from work, I'm on a monitor that's calibrated monthly with GretagMacbeth Eye-One hardware too, so if you ever have a color question, feel free to holla.

By the way, what kind of camera are you using?
