The line the administration is now taking is that they are protecting the sanctity of separation of powers. Rumsfeld was quoted on a news show this weekend saying basically this. For Condi to be put under oath and made to testify, that would be an infringing on the power of the executive branch.

Even Richard Perle was quoted as saying that this isn't a good enough excuse, and that it would suit her best to testify. But her supposed concern is that it will hinder her ability as a security advisor to speak candidly with the president.
