Yeah, I think it's kind of disgusting that they took an almost Clintonesque out on this case. They know they will obe day have to address the whole issue nof what W is doing with Presidential power, the know this case would have done that, and they basically said, well, they're giving him a trial now, so we don't have to take the case yet, we don't have to take this case at all and we don't want to even look at this issue until we have no choice whatsoever.

It doesn't bode well for the furture either, because the case they just heard on habeas corpus has similar outs in it. The administration is arguing that A.) Congress has the right to tell the Supreme court it doesn't have the right to hear certain cases, and B.) That same law INADVERTANTLY takes away cases currently on the court docket. Both arguments are pure legal sophistry, but they are an out for a court that doesn't want to confront an ugly constitutional crisis.
